Terms of Service

These terms are a contract between you and Scaling Services LLC, the company that operates OpenCEU. By creating an account or using openceu.com, you agree to them. We've kept the language as plain as a contract allows.
1. Who we are
OpenCEU (openceu.com) is operated by Scaling Services LLC, a Florida limited liability company (“OpenCEU,” “we,” “us”). OpenCEU is a platform for hosting, attending, and tracking behavior-analytic continuing education: live CEU events, recorded courses, comprehension quizzes, certificates, and related tools.
OpenCEU is not the Behavior Analyst Certification Board (BACB) and is not endorsed by or affiliated with the BACB. Continuing-education requirements are set by your certification body; responsibility for meeting them stays with you and, for hosted events, with the ACE Provider hosting the event.
2. Who may use OpenCEU
You must be at least 18 years old. OpenCEU is built for behavior-analytic professionals (BCBAs, BCaBAs, RBTs, trainees) and the organizations that provide their continuing education. You agree to give us accurate account information (including your name and, where applicable, your BACB certification number, which appears on your certificates) and to keep your login credentials to yourself.
3. CEU integrity — the important one
Certificates issued through OpenCEU are compliance documents. So:
- You must personally complete the event, attendance checks, and quizzes tied to your account. No sharing logins, no completing checks for someone else, no automating or scripting attendance.
- Attendance and quiz records are captured with timestamps (and, for live events, identity confirmation) so they hold up in a BACB audit — for your benefit and the provider’s.
- If we determine a certificate was obtained through misrepresentation, credential sharing, or automated completion, we may revoke it and notify the hosting provider. Revoked certificates are marked as revoked, not deleted, so the audit trail stays intact.
4. For hosts (ACE Providers)
If you host events on OpenCEU:
- Your compliance is yours. You are responsible for your ACE Provider status, event content, instructor qualifications, CEU calculations, disclosures, and everything else your certification body requires. OpenCEU provides tooling (attendance capture, certificates, audit records), not compliance itself.
- Your content stays yours.You grant us a license to host, stream, transcode, caption, transcribe, and display your event content so the platform can do its job (including generating quizzes, captions, and thumbnails from your recordings). We don’t sell your content or use it outside operating the platform.
- Attendee data. You can view and export the roster (names, emails, attendance and completion records) for events you host, for your own compliance, customer service, and communications. Once exported, you are independently responsible for how you use it and for complying with applicable law (including honoring unsubscribes on your own communications).
- Payments and refunds. Paid events are processed through your own Stripe account via Stripe Connect. You set your prices and you handle refunds. Platform fees, if any, are as disclosed in your host dashboard at the time of sale.
- Earned CEUs survive refunds. A legitimately earned CEU certificate is a record of completed continuing education; issuing a refund does not revoke it.
- You will indemnify us against claims arising from your event content or your use of exported attendee data.
5. Payments
All payments are processed by Stripe. We never see or store your full card number. Prices for paid events are set by the hosting provider and shown before you pay. For refunds on a paid event, contact the event’s host — refunds are issued by the host through their own payment account.
6. Advertising
OpenCEU is free to use because sponsors advertise on the platform. Sponsor ads are always labeled (“Ad · Sponsor of OpenCEU”), never appear on certificates, and never count toward instruction time. Clicking an ad takes you to the sponsor’s own website, which has its own terms and privacy practices. See our Privacy Policy for exactly what sponsors do and don’t learn about you (short version: nothing, unless you click through and give them your information yourself).
7. Acceptable use
Don’t:
- break the CEU-integrity rules in Section 3;
- scrape, harvest, or bulk-download platform data, or probe, overload, or circumvent our security controls;
- upload malicious code or content you don’t have rights to;
- harass other attendees, speakers, or hosts (including in event chat);
- resell or redistribute platform content outside your own organization.
We may suspend or terminate accounts that violate these terms. You can delete your account at any time in Settings.
8. Records and account deletion
When you delete your account, we delete your profile and login data. Compliance records — issued certificates, attendance logs, quiz responses, and identity confirmations — are retained for seven (7) yearsas audit records, because a continuing-education record can’t simply vanish: you, the hosting provider, or the BACB may need to verify it years later. Details in the Privacy Policy.
9. Disclaimers
OpenCEU is provided “as is.” We work hard to keep the platform available and accurate, but we don’t warrant uninterrupted service, and we are not responsible for the content of hosted events or for whether a given certificate satisfies your specific certification requirements. Nothing on OpenCEU is clinical, legal, or professional advice.
10. Limitation of liability
To the maximum extent permitted by law, Scaling Services LLC’s total liability arising out of or relating to OpenCEU is limited to the greater of (a) the amount you paid through the platform in the twelve months before the claim, or (b) one hundred US dollars ($100). We are not liable for indirect, incidental, or consequential damages.
11. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
12. Changes
If we change these terms in a way that matters, we’ll update the date at the top and, for significant changes, notify you by email or an in-app notice. Continuing to use OpenCEU after a change means you accept the new terms.
